Formed Concrete Basins Limited Warranty

To the extent permitted by law, this Limited Warranty replaces all other warranties—whether written, oral, express, or implied—including warranties of merchantability, fitness for a particular purpose, and protection against hidden or latent defects. As the original purchaser, you may have additional rights under local laws, which this Warranty does not override. At Formed Concrete Basins, we are committed to delivering beautifully crafted products and ensuring your satisfaction. This Limited Warranty reflects that commitment, as outlined below.

1. Conditions

This Warranty applies exclusively to the original purchaser of the Product and covers only the specific Product purchased. The Warranty remains valid only while the original purchaser retains ownership. The purchaser acknowledges responsibility for determining the suitability of the Product for its intended use.

2. Extent of Coverage

Formed Concrete Basins warrants that the formed concrete basin (the “Product”):

• 
  (a) conforms to all published specifications; and
  
• 
  (b) is free from defects in materials and workmanship.
  

Warranty coverage duration varies by Product type, as detailed below. If the Product fails to meet specifications or is defective during the Warranty Period, you must notify Formed Concrete Basins in writing promptly and before the Warranty expires.

3. Return Procedure

After notification, the Product must be returned within a reasonable time—and in all cases before the Warranty Period ends—to the address provided by Formed Concrete Basins. Returns must include:

  (a) Product name and description
  
• 
  (b) Return shipping address
  
• 
  (c) Daytime phone number
  
• 
  (d) Copy of original purchase receipt
  
• 
  (e) Reason for return
  

Shipping and insurance costs for the return are the purchaser’s responsibility. Damages caused by improper packaging or transport are not covered. If returned after the Warranty Period, or if the issue is not covered, repair or replacement costs must be approved and paid by the purchaser before work begins.

4. Service and Repair

Within 30 days of receiving the returned Product, Formed Concrete Basins will:

• 
  Repair defects in materials or workmanship; or
  
• 
  Correct any failure to meet published specifications.
  

Repairs will use new or equivalent parts and will be performed at the return location, with Formed Concrete Basins determining the repair method. If repair is not possible, Formed Concrete Basins may:

• 
  (a) provide a replacement Product; or
  
• 
  (b) issue a full refund.
  

Standard return shipping costs will be covered by Formed Concrete Basins; any expedited or additional shipping charges are the purchaser’s responsibility. These remedies are the purchaser’s exclusive options for warranty or legal claims related to the Product.

5. Exclusions

This Warranty does not cover:

  (a) Minor variations in color, finish, or texture
  
• 
  (b) Components not manufactured by Formed Concrete Basins
  
• 
  (c) Improper installation or unsuitable environments
  
• 
  (d) Failure to follow installation instructions or use certified professionals when required
  
• 
  (e) Misuse or use beyond design limits
  
• 
  (f) Damage caused by external events such as fire or flood
  
• 
  (g) Unauthorized modifications
  
• 
  (h) Cosmetic damage not caused by defects
  
• 
  (i) Damage from misuse, negligence, or abuse
  

6. Limitation of Liability

Except as expressly stated and to the fullest extent allowed by law, Formed Concrete Basins is not liable for damages from use or inability to use the Product, including but not limited to:

• 
  Loss of profits, revenue, or savings
  
• 
  Business interruption or downtime
  
• 
  Costs of replacement equipment or services
  
• 
  Property damage
  
• 
  Third-party claims
  

Where financial damages are allowed, liability is limited to the original purchase price. This does not apply to claims involving personal injury or death. Some jurisdictions may not allow these limitations, so they may not apply in all cases.

7. Commencement of Claims

Any warranty claim must be made within one (1) year from when the issue occurs. The purchaser agrees that the time limit starts at the moment the problem arises, even if unknown at the time.

8. Acceptance by Purchaser

By receiving, accepting, or paying for the Product, you agree to this Warranty’s terms. Orders are only accepted by Formed Concrete Basins if you agree to these terms.

9. No Other Warranty

This Warranty is the entire agreement between you and Formed Concrete Basins, replacing any prior agreements or communications. No employee, reseller, or agent may change this Warranty unless in writing signed by both parties.

10. Allocation of Risks

This Warranty defines how the risks of Product failure are shared between you and Formed Concrete Basins. Both parties acknowledge this allocation, which is reflected in the Product price. By purchasing, you confirm that you have read, understood, and agree to these terms.
